Deportation and Removal Matters

 

The UK Border Agency (UKBA) has power to deport (Deportation) or remove (Removal) from the UK any foreign national whether you have Indefinite Leave or Limited Leave to Remain in the UK. These two methods are different and could be applied by the UKBA depending of the circumstances of each case.

Deportation

 

Foreign nationals, regardless of their leave to remain in the UK, could often be deported following a conviction for a crime in the UK. This can be by way of a recommendation by the Court or by the Home Office exercising its power to deport. The ground the Home Office often uses to deport convicted foreign nationals is justified by its duty to protect the UK public. Sometimes, a family member of the subject of deportation would also be required to leave with the person being deported. Once deported from the UK, return will be prohibited, unless the deportation order is revoked.

Removal

 

All foreign nationals, including their families, without valid leave to remain in the UK are subject to removal. The process of removing someone from the UK more often results in long detentions due to lack of travel documents or other unforeseen impediments. It can even result in unlawful detention issues arising due to long detentions with no prospect of effecting removal directions. This is why legal advice is essential at this stage.

 

Deportation as well as removal can be challenged by way of appeal to an Independent Immigration Judge. The process of challenging the deportation or removal is complicated and the implications of such an action can be damaging. It is for this reason that you must seek legal advice immediately.
